1.QP shall use the TOP form to apply for TOP clearance for a completed development after he has inspected and confirmed the following:

i.The sanitary/sewerage works have been completed in accordance with the registered DPs on Sewerage. A Certificate of Completion and Inspection for Sanitary/Sewerage Works has been submitted to Sewerage Department;
ii.The industrial plant and related pollution control works (for an industrial development) have been completed in accordance with the BPs on PC.

2.Upon receipt of the Certificate of Completion, PUB(WRN Dept) may carry out checks on the completed sanitary/sewerage works and inform CBPU if the sanitary/sewerage works have been constructed in accordance with the registered DPs.

3.CBPU will arrange with QP to carry out inspection of the completed industrial plant and its related pollution control works.

4.Should there be a dispute on the interpretation of compliance with environmental requirement at TOP stage, QP may refer the dispute to the following 2-level appeal mechanism:

(a) Level 1

QP refers a dispute to the Statutory Boards (NEA - for pollution control matter and PUB - for sewerage matter).

If QP is not satisfied with the decision, he will refer the dispute to an Appeal Committee at Level 2. The Appeal Committee is chaired by CE(CBPU) and comprises a member each from SIA, IES, ACES and the representatives from NEA/ PUB. 

(b) Level 2

The Appeal Committee will sit and consider the dispute and may invite the QP to present his dispute.

The decision of the Appeal Committee shall be final.

5.CBPU will issue a TOP clearance after PUB(WRN Dept) has informed CBPU that the sanitary/sewerage works are in order and for an industrial plant, the pollution control works were inspected and found to be in order. CBPU will process the application for TOP within 7 working days.
